A judge in North Dakota has struck down the state's abortion ban, ruling that the state constitution protects a woman's right to have an abortion up to a gestational age at which the fetus is considered viable. Judge Bruce Romanick said in his ruling that the ban was too vague and therefore “null and void.” He also said that the law “at issue in this case violates women’s fundamental right to procreative autonomy and is not narrowly designed to promote women’s health or protect the lives of unborn human beings.” North Dakota's attorney general, led by a Republican, has said it will appeal the ruling. Abortion is permitted in the state in cases of rape and incest, if the pregnancy is less than six weeks or if there is a risk to the health of the pregnant mother. Romanick's ruling is not expected to have an immediate impact on women in the state's ability to access abortions, as there are currently no medical facilities there that provide the procedure.
