Temple teacher remains fired over blog post

ALBANY, N.Y. — New York’s appellate court upheld the dismissal of a former Westchester Reform Temple teacher’s claim that she lost her job for a blog post critical of Zionism and Israel she wrote in her free time, which she says violates state labor law against adverse actions over employees’ legal “recreational activities.” Without addressing whether blogging or expressing personal views constitutes a recreational activity, the high court finds that her claim is barred by the ministerial exception precluding the application of employment discrimination laws to claims concerning religious institutions and their ministers.
