FTC rule struck down

TYLER — A federal court in Texas struck down a Federal Trade Commission rule expanding the amount of information merging companies have to provide in their premerger notifications to antitrust enforcers at the FTC and U.S. Department of Justice. The FTC exceeded its statutory authority when issuing the rule and failed to back up its argument that the rule would help detect illegal mergers and save agency resources. The FTC also failed to explain why it rejected less costly alternatives.
