HOUSTON — A mother upset that her daughter was named co-captain rather than captain of her high school’s cheerleading team can’t proceed with her lawsuit against the school district, a Texas court of appeals ruled. The mother argued that the school breached its “Cheer Constitution” by improperly holding two sets of tryouts. The cheer constitution unambiguously states that cheerleading is a privilege and that it can be unilaterally amended by the district, so it is not a contract that can be enforced.
