Damages limited for dog death

COLUMBIA — A woman whose dog, Xumi, was killed and whose other dog, Ruben, was seriously injured while in the care of a dog daycare can’t recover damages for emotional distress, the South Carolina Court of Appeals ruled. The state classifies pets as personal property, which limits damages to the dog’s market value. It would be up to the state’s legislature, not the courts, to make emotional damages available for the loss of a pet. The appeals court declined to rule on whether “special value” should be considered when determining the value of the dog because that issue was not before the court.
