Zomato Fined Rs. 15,000 for Missing Dosa & Uttapam by the Court

Zomato was ordered by a district consumer complaints redressal commission to pay a Chennai resident a fine of Rs 15,000 for missing food items Dosa and Uttapam after the customer placed an order worth Rupees 498. The incident occurred on August 21, 2023 in Poontamalli. Tiruvullar resident Anand Shekhar had ordered food worth Rs 498 in August 2023, from Akshaya Bhavan, a local restaurant, including uttapam and dosa, through Zomato. After receiving the food order, he realized a few items were missing and immediately called Zomato Customer Service Center officer to solve the issue. Anand filed a complaint with the Tiruvallur district consumer complaints redressal commission after failed to get any support from customer executives. The case came up for hearing in the Thiruvallur Consumer Court and during the hearing, Zomato said, "Our job is to act as a middleman between the restaurant and the customer and buy the food ordered by the customer from the relevant hotel. Also, the parcel is delivered by the hotel management. We cannot verify the quality of the food inside it. The hotel management should have been made a party in this case." But the Court President, Latha Maheshwari, refused the claim and said Zomato has been charging Rs. 73 as a service fee from the customer, "Therefore, Zomato is responsible for correcting whether the service is being provided properly; moreover, the petitioner's contract is directly with Zomato." The commission then ordered Zomato to compensate Anand for the Rs 498 he had paid on the food order, along with Rs 10,000 for the emotional stress he had suffered and Rs 5,000 for his legal costs.
