FRESNO, Calif. — Walmart prevailed in a lawsuit filed by a former employee who says he was forced to resign because he was unwilling to comply with the big-box retail giant’s policy of giving customers plastic bags for free when they refused or failed to pay the 10-cent fee per bag. The court described this as “the type of trivial misconduct that does not support a claim for constructive discharge.” He also brought wage-and-hour claims, but they were not sufficiently pleaded.
