SACRAMENTO — A federal judge in California refused to dismiss a putative class action accusing hospice provider Vitas Healthcare of allowing a third-party software developer to record calls between Vitas and its customers in violation of California privacy laws. The customer sufficiently pleads that the developer was using the data for its own business purposes and that the hospice provider may be held liable for aiding the developer in obtaining the calls.
