TACOMA, Wash. — In a trademark lawsuit brought by the Foxy Lady, an adult entertainment club located in Rhode Island, against the Washington state chain of “bikini barista establishments” called Foxy Lady Coffee, a Washington federal court declined to grant default judgment to the out-of-state business. The “foxy lady” mark is “presumptively weak,” and consumers in Washington “are not likely to expect to find coffee kiosks sponsored by strip clubs from the other side of the country,” so customer confusion is unlikely.
