CHICAGO — A genetic testing company largely lost its bid for dismissal of a putative class action accusing it of falsely marketing its genetic testing to screen in vitro-fertilized embryos for chromosomal abnormalities as being 98% accurate. The test purchasers sufficiently allege that Reproductive Genetic Innovations Inc. was aware of scientific research regarding problems with preimplantation genetic screening and should have known that its representations were misleading, a federal judge in Illinois ruled.
